Oklahoma Air Permits

Oklahoma DEQ's Air Quality Division issues permits under OAC 252:100 Subchapter 7 (minor facilities) and Subchapter 8 (Part 70 and major source construction permits), with public participation tiers set by OAC 252:4-7. Options include permit-exempt and de minimis facilities, Permits by Rule (including a Minor Oil and Natural Gas PBR), general permits (including the Oil & Gas Facilities GP), individual minor source construction and operating permits (Tier I), major source/Part 70 permits (Tier II), and PSD permits (Tier III). Minor NSR allows some construction after an administratively complete application, at the applicant's risk.

Air permits & authorizations

  • Permit exempt facilities

    Exemption

No air permit needed if the facility's potential to emit is below major source levels, its actual criteria pollutant emissions are low, and it is not subject to any NSPS or NESHAP emission, equipment, or work practice standard. De minimis facilities and activities (OAC 252:100 Appendix H) are separately defined.

Quoted verbatim from the agency source
100 tons/year of any criteria pollutant ... 10 tons/year of any individual federally defined hazardous air pollutant ... 25 tons/year of all HAPs combined

Thresholds (summarized from source, not a quotation)

Actual emissions of each criteria pollutant below 40 tons/year (restated from DEQ).

  • Permits by Rule (PBR)

    Permit by Rule

Registration-based authorizations for: cotton gins (252:100-7-60.1), grain elevators (252:100-7-60.2), minor oil and natural gas facilities (252:100-7-60.5), emergency engines (252:100-7-60.6), gasoline dispensing (252:100-7-60.7), particulate matter emission sources (252:100-19-13), and VOC storage and loading (252:100-37 Part 9). DEQ's guide lists PBR registration fees for construction and operation.

  • General Permits

    General Permit

General permits for air curtain incinerators; area source NESHAP and small NSPS facilities; chromium electroplating/anodizing (also halogenated solvent cleaning); dry cleaning; hot mix asphalt (2024 GP; 2002 GP holders must transition by April 1, 2026); nonmetallic mineral processing (2026 GP; 2007 GP holders by October 2, 2028); oil and gas facilities; and printing, packaging, and publishing.

  • Minor Source Construction and Operating Permits (Tier I)

    Minor NSR

Required for facilities that are not permit exempt and not covered by a PBR or general permit. Individual minor source permits have a 30-day public review posted on DEQ's website. Typical timeline 4-6 months. Construction may begin after an administratively complete application, but not to the point of making an emissions unit operational.

Thresholds (summarized from source, not a quotation)

A modification increasing emissions by 5 tpy or more of a regulated pollutant triggers a construction permit (restated from DEQ's 2024 rulemaking presentation).

Major NSR (PSD & nonattainment)

  • PSD-Major Source Permit (Tier III)

    PSD

For large new sources and major modifications in attainment areas. Requires a 30-day draft permit review, a 20-day proposed permit review, a process meeting opportunity, and possible administrative hearing; issued by the Executive Director. Typical timeline 9-12 months.

Quoted verbatim from the agency source
    250 tons/year

  • Nonattainment NSR

    Nonattainment NSR

Major stationary sources in nonattainment areas are defined under OAC 252:100-8-51. Oklahoma's general permits exclude facilities in nonattainment areas.

Title V operating permits

  • Major Source / Part 70 Permit (Tier II)

    Title V

Part 70 construction and operating permits for major sources. Requires newspaper notice, a draft permit with 30-day comment, and possible public meeting. Typical timeline 6-9 months. A state (non-PSD) BACT and modeling review applies to large increases that don't require PSD.

Thresholds (summarized from source, not a quotation)

Major source at 100 tpy (Part 70), 10 tpy single HAP, 25 tpy combined HAPs (restated from DEQ's Permit Assistance Guide and 2024 AQAC presentation). State BACT/modeling review: increases of 100 tpy that don't require PSD (restated).

Oil & Gas

Oklahoma has two oil and gas specific authorizations: the Minor Oil and Natural Gas Permit by Rule (OAC 252:100-7-60.5, emergency rule effective July 25, 2024) and the General Permit for Oil & Gas Facilities (GP-OGF, 2022, Version 2 per a December 2023 memo). The PBR includes an option for legally and practicably enforceable limits on tank batteries to stay below NSPS OOOOb storage vessel thresholds. Methane and GHGs in the aggregate are excluded from certain PBR determinations.

  • Minor Oil and Natural Gas PBR

    Permit by Rule

For minor oil and gas facilities whose potential emissions stay below PSD, NNSR, and Part 70 triggers. Covers NSPS OOOO/OOOOa/OOOOb, IIII, JJJJ, NESHAP HH and ZZZZ sources at minor/area facilities. Storage vessel and tank battery options use 12-month rolling limits with controls.

Quoted verbatim from the agency source
The facility has actual emissions of 40 TPY or less of each regulated air pollutant, except HAPs and GHGs.

Thresholds (summarized from source, not a quotation)

Storage vessel options: 6 tpy VOC, and 20 tpy methane for the OOOOb LPE option, 12-month rolling (restated from DEQ).

  • General Permit for Oil & Gas Facilities (GP-OGF)

    General Permit

For minor facilities in attainment areas that produce, gather, process, store, or transport crude oil, petroleum products, natural gas, NGL, or condensate. File a Notice of Intent to Construct before construction (coverage effective on receipt with fee); Authorization to Operate is due within 180 days of startup; some changes need only a Notice of Modification within 15 days. Class I and Class II tiers. Some facilities (e.g., sour crude or gas above stated H2S levels, multiple amine units, large fuel-burning equipment) cannot get an Authorization to Construct under the GP.

Quoted verbatim from the agency source
less than 100 tons/year (TPY) of a regulated pollutant in an attainment area ... less than 10 TPY of any single hazardous air pollutant (HAP) ... less than 25 TPY of total HAPs

Thresholds (summarized from source, not a quotation)

Class I: limits below 80% of major levels; Class II: below 100%. Fuel-burning equipment of 50 MMBtu/hr or more is excluded from Authorization to Construct (restated from DEQ).
