New Jersey Air Permits

NJDEP issues all air permits in New Jersey: preconstruction permits, PSD, nonattainment NSR, and Title V. Minor facilities need a preconstruction permit and operating certificate under N.J.A.C. 7:27-8 for any 'significant source', as listed in 7:27-8.2(c). A facility gets this either by registering online for a general permit, with immediate authorization to construct, or through case-by-case review using the RADIUS application software. Major facilities need a Title V operating permit under N.J.A.C. 7:27-22, either as a General Operating Permit (GOP) or case by case. New Jersey is in the Ozone Transport Region, which lowers major source thresholds (see the Nonattainment NSR entry). There are no local air permitting agencies.

Partially verified. NJDEP's own website (dep.nj.gov) refused automated access throughout this review, so its current pages, the full general permit list, and the current rule text could not be read. Thresholds come from EPA's 2018 incorporation-by-reference copy of Subchapter 8 and may have been amended since. The general permit list, fees, and processing times come from an undated NJDEP training deck and should be checked against the current BOSS general permits page. The Subchapter 18 title is the standard rule title and was not seen in text.

Air permits & authorizations

  • Below 'significant source' thresholds / 7:27-8.2(d) exemptions

    Exemption

Equipment that is not a significant source under 7:27-8.2(c) needs no permit. Subsection 8.2(d) lists 21 exemptions, such as pressurized storage tanks, POTW aeration basins and lagoons, construction/repair/maintenance (CRM) equipment, and portable equipment. Many carry conditions.

Any equipment or source operation that may emit one or more air contaminants, except carbon dioxide (CO2),

Thresholds (summarized from source, not a quotation)

Selected significant-source triggers, quoted from 7:27-8.2(c) as of Jan 16, 2018: commercial fuel burning equipment with a maximum rated heat input of 1,000,000 BTU per hour or greater (c)1; potential to emit Group 1 or 2 TXS at a rate greater than 0.1 pounds per hour (c)2; tanks over 10,000 gallons (c)8; tanks of 2,000 gallons or greater holding VOC at 0.02 psia or greater (c)9; raw materials exceeding 50 lb in any one hour (c)19; non-emergency stationary engines of 37 kW or greater (c)21.

  • General Permits (minor facilities)

    General Permit

Registered online through NJDEP's online business portal, with immediate authorization to construct. Examples: GP-005A (distillate emergency generators), GP-005B (gaseous-fuel emergency generators), GP-016A Small Emitter General Air Permit (SEGAP), GP-017A and GP-018A (boilers/heaters), GP-021 (CHP combustion turbines), and GP-022 (CHP spark-ignition engines). The registration fee for multiple pieces of equipment is $820. Generators used for demand response cannot use a general permit.

Thresholds (summarized from source, not a quotation)

    Size limits (restated from NJDEP training slides): GP-005A under 100 MMBtu/hr; GP-005B under 70 MMBtu/hr; GP-017A under 5 MMBtu/hr; GP-018A 5 to under 10 MMBtu/hr; GP-021/GP-022 65 MMBtu/hr or less at 65% or greater efficiency.

  • Preconstruction Permit and Operating Certificate (case-by-case)

    Minor NSR

Applications are submitted through the RADIUS program, online or by mail. NJDEP reports average processing of 30 to 60 days for minor sources. The fee is $2,527 plus $590 for each additional piece of equipment. Review typically includes State of the Art (SOTA), NOx RACT where applicable, and risk screening for air toxics.

Major NSR (PSD & nonattainment)

  • Prevention of Significant Deterioration (PSD)

    PSD

NJDEP issues PSD permits (per EPA's CAA Permitting in New Jersey page). The pages reviewed do not restate numeric thresholds.

  • Nonattainment NSR (Emission Offsets)

    Nonattainment NSR

NJDEP issues nonattainment NSR permits (per EPA). Emission offset requirements are in N.J.A.C. 7:27-18. New Jersey is in the Ozone Transport Region.

Title V operating permits

  • Title V Operating Permit (case-by-case or General Operating Permit)

    Title V

Required for major facilities. These are issued either as a GOP, for example GOP-003 (a single 2007-or-later distillate emergency generator) or GOP-004 (a single gaseous-fuel emergency generator), or case by case. EPA's SIP listing shows Subchapter 22 effective November 2, 2020.

Thresholds (summarized from source, not a quotation)

GOP-003: 30 MMBtu/hr or less (restated from NJDEP training slides).

Oil & Gas

New Jersey has no oil and gas production. Natural gas compressor stations, refineries, and terminals use the preconstruction and Title V framework, and storage tanks are significant sources under 7:27-8.2(c)8-9.
