Minnesota Air Permits

In Minnesota a facility needs an air permit when its potential to emit exceeds a permitting threshold, unless it is an insignificant facility or a conditionally exempt source. State permits for minor sources include one-page registration permits, capped emission permits, a state general permit, and individual state total facility permits. Federal permits are Part 70 individual permits and a Part 70 manufacturing general permit. Rules are in Minn. R. ch. 7007 (permits) and ch. 7008 (conditionally exempt sources).

Air permits & authorizations

  • Insignificant facilities and conditionally exempt sources

    Exemption

Insignificant facilities may not need a permit (MPCA offers a PTE calculator). Conditionally exempt sources (e.g., auto body, coating, woodworking, gasoline stations, concrete manufacturers) may exceed thresholds but follow technical standards and usually notify MPCA instead of getting a permit.

  • Registration Permits (incl. Option D)

    Registration / Notice

One-page, non-expiring state permits for facilities whose actual emissions are low compared to potential. Not available to acid rain sources, waste combustors, or facilities with SIP requirements or certain NSPS.

Thresholds (summarized from source, not a quotation)

Per MPCA (Option D, actual emissions): under 50 tpy each of PM, PM10, VOC, SO2, NOx, CO; under 5 tpy single HAP; under 12.5 tpy all HAPs; under 0.5 tpy lead; under 50,000 tpy CO2e.

  • Capped Emission Permit

    State Operating

Caps facility-wide emissions to stay below Part 70 or NSR major thresholds; changes allowed without amendment while under the cap. Single-page permit.

Thresholds (summarized from source, not a quotation)

Per MPCA: actual emissions under 75%-90% of federal thresholds (e.g., Option 1 under 90 tpy listed pollutants including insignificant activities).

  • State General Permit

    General Permit

One state general permit is currently available, for non-metallic mineral processing.

  • Individual State Total Facility Permit

    Minor NSR

Facility-specific permit with limits to remain minor for NSR and Part 70; 30-day public notice; five-year term; amendments required for changes.

Major NSR (PSD & nonattainment)

  • PSD / NSR

    PSD

Major NSR applies depending on source category; individual Part 70 permits often include limits to remain minor for NSR.

Thresholds (summarized from source, not a quotation)

100 or 250 tpy depending on source category (restated from MPCA).

Title V operating permits

  • Part 70 Individual and General Permits

    Title V

Individual permits for the largest facilities (30-day public comment, 45-day EPA review, five-year renewal). A Part 70 general permit covers manufacturing facilities.

Oil & Gas

Minnesota has no oil and gas production. MPCA's permit pages list no oil-and-gas-specific air program; stationary engine guidance applies to compressor and generator engines.
