Florida Air Permits

Florida DEP requires an air construction permit before building or modifying non-exempt emissions units, and an air operation permit to operate. Many small sources qualify for categorical, conditional, or generic exemptions (Rule 62-210.300(3), F.A.C.) or for one of the air general permits (Rule 62-210.310). Minor construction permits are processed by DEP districts or approved local programs; PSD, nonattainment NSR, and power plant permits are processed by the Division. Operation permits are state-only (natural or synthetic minor), federally enforceable state operation permits (FESOP), or Title V (Chapter 62-213).

Air permits & authorizations

  • Categorical, conditional, generic, and case-by-case exemptions

    Exemption

Categorical exemptions cover whole unit categories (e.g., space heaters other than boilers, welding, vehicle refueling); conditional exemptions apply below set capacities with records; generic exemptions apply to units with potential emissions below defined thresholds and no unit-specific requirements; case-by-case exemptions under Rule 62-4.040. A Title V major source may not be exempt from permitting.

  • Air General Permits

    General Permit

Registration-based permits (five-year maximum, $100 processing fee) for animal and human crematories, asbestos fabrication, asphalt concrete plants, bulk gasoline plants, cast polymer, chromium electroplaters, concrete batching, ethylene oxide sterilizers, halogenated solvent degreasers, mercury recovery, nonmetallic mineral processing, perc dry cleaners, printing, RICE, reinforced polyester resin, secondary aluminum sweat furnaces, and surface coating. Registered online through AGPERS.

  • Minor Air Construction Permit

    Minor NSR

Required before construction when activities are not exempt and no general permit fits. Application sealed by a Florida-registered PE. Processing fee under Rule 62-4.050 (none for existing Title V facilities).

    Chapters 62-4, 62-204, 62-210, 62-212, F.A.C.Official page
  • Non-Title V Operation Permits (state-only and FESOP)

    State Operating

State-only permits for natural and synthetic minor sources; FESOPs set federally enforceable facility-wide limits to establish synthetic minor status (14-day public comment). Terms up to five years; minor source renewals due at least 60 days before expiration.

Major NSR (PSD & nonattainment)

  • PSD Permit

    PSD

Processed by the Division; requires applicability analysis, BACT, dispersion modeling, and additional impacts analysis.

Thresholds (summarized from source, not a quotation)

Per DEP: new major source with potential emissions of a PSD pollutant at or above 100 tpy (including fugitives) in one of the 28 listed categories, or at or above 250 tpy otherwise; or a major modification at or above the significant emission rate in Rule 62-210.200.

  • Nonattainment New Source Review

    Nonattainment NSR

For projects in nonattainment areas (DEP lists SO2 in Hillsborough and Nassau counties and lead in the Tampa Bay region) or their area of influence. Requires LAER and offsets before construction.

Title V operating permits

  • Title V Major Source Operation Permit

    Title V

Comprehensive permit for major sources. No processing fee; annual operating fees based on actual emissions. Renewal due at least 225 days before expiration.

Thresholds (summarized from source, not a quotation)

Per DEP: PSD major source; 100 tpy or more of any regulated air pollutant; 25 tpy or more of combined HAP; 10 tpy or more of any single HAP; 5 tpy or more of lead; NSPS/NESHAP categories requiring Title V; or major under lower nonattainment thresholds.

Oil & Gas

DEP's air permitting pages list no oil-and-gas-specific air permit. Engines can use the RICE air general permit, and bulk gasoline plants have their own general permit.

  • Air General Permit: Reciprocating Internal Combustion Engines

    General Permit

    General permit for RICE.

  • Air General Permit: Bulk Gasoline Plants

    General Permit

General permit for bulk gasoline plants.
